I've heard of dealers out there that do sell the R8 at MSRP, but they usually don't last long. One of the highest mark-ups I've ever seen on a '09 R8 was $50,000 at a dealer. I would say any of the used R8's you see on Ebay are people who are trying to flip for a profit(but im sure you knew that.)
But anyway, this is good news for everyone since you no longer have to haggle down the mark-up price at the dealer, like I had to do.
And on a side note, I'm amazed to see NEW 09' R8's are for sale even though all the orders were filled? Do they make extra for the dealers to put on the showroom floor or something?

$50K over was wut they were asking till recently. But I have doubt that anyone would pay $50K over for it, that make no sense. At one point , I was told that they were not even taking anymore deposit. I was all ready to wait between 1.5 to 2 yrs for mine. But it looks like I will be getting my car in 7 to 8 months.
I am thinking the dealer get to pick how many cars for themselves(cos it was selling like hot cake, and they can make a killing) and put everyone els who want one at MSRP on a long waiting list. But with the economy in the toilet, that list is probably much shorter now.
The economic climate is affecting everyone and there will be people who placed orders who are no longer able to go through with the buy. I think the discrepency on price is a mix of different geographic areas and also some of the older listings by people who haven't really accepted the changes going on economically.
the key thing is always what people actually pay not what people ask for something.

I don't know where you live, mdc, but in the U.S. the market is very fragmented, with huge regional variations.
I live in Chicago and first tried to order an R8 through local dealers. Only one was even taking deposits, and he said the wait would be over a year, no matter what premium I would be willing to pay. Another dealer in the north suburbs sold his first R8 for $50,000 over sticker. A downtown Chicago Audi dealer -- which was not even authorized to sell or work on R8's -- was taking names to get on a list for cars they were hoping to purchase from "flippers" and resell at stiff markups.
So I got on the telephone in September 2007 and began calling dealers all over the U.S. Before long, I came across a nice little dealership in Vermont who had allocations for two cars but only one order. So he took my order and guaranteed to deliver the car at MSRP. He said I had a good chance of getting the car by March 2008. In early December he called to say the car was already built and would be at his dealership shortly after Christmas.
On January 3, 2008 I flew to Vermont, picked up exactly the car I ordered, paid list price, had a very nice visit with some locals who dropped by to meet the guy who had bought the R8, and had great fun driving the car cross country back to Chicago. (The dealer had also taken care of mounting OZ winter wheels and all-season tires on the car before delivery. He then took care of shipping the factory wheels and tires to me . . . charging only his costs for doing all this.)
There are some very decent dealers out there. But you won't find most of them around urban centers.
I am glad that works out nicely for you. Wut a great story. I am in California, I made a few calls late Spring/summer trying to locate the R8, and came across some really rude sales people. They were just too good to even border to take the time to talk to me. All they ask is how much am I willing to pay. I ended up ordering it from my local dealer, and should have the car here by early part of next year. I will believe it when I see it, but Audi did sent me a nice coffee table book a few wks ago to tie me over while I am waiting. I like to think they are going to sell at msrp from here out based on the few that sold recently. It is always odd to some on ebay still asking a premium on 08 while the 09 are selling at msrp...
